Chief Judge of the Federal High Court has returned the case file in the leader of the Indigenous People of Biafra (IPOB) Nnamdi Kanu’s treason trial to Justice Binta Nyako to continue hearing the case.
Following the September 24 rejection of the Judge by Kanu, who alleged lack of confidence in here, Justice Binta washed her hands off the case.
Kanu claimed he no longer had confidence in the Judge’s ability to ensure fair hearing.
However, Chief Judge of the Federal High Court, Justice John Tsoho, directed that Justice Nyako should continue to preside over the case while Kanu should file a formal application, supported with an affidavit, detailing reasons why the trial should be transferred to an alternative Judge.
Justice Tsoho, similarly directed that the Prosecution respond to Kanu’s application, following which Justice Nyako would hear the application and give a ruling, deciding whether or not to withdraw.
